今日は月曜日なので 薬機法 関連の話題をお伝えします。
先週末のことですが、こんなニュースが飛び込んできました。
「サミー」広告が物議を醸した
≪厚労省 「サミー」広告で調査、指導も視野「医薬品成分を強調」≫
日本天然物研究所が６月１７日付朝日新聞で”医薬品成分”に分類される「サミー」が持つ効果を説明していた。（画像下部分）
それだけならただの意見広告だが、翌１８日にはナチュラルガーデンが「サミーウォーカー」という商品の広告を掲載。（画像上部分）
医薬品成分であるはずの「サミー」を含有していることを記載していた。
薬事法上の医薬品は「成分本質（原材料）」など４点から判断される。
「サミー」は食薬区分に例示されている専ら医薬品リストに掲載される医薬品原料。このため、商品と一緒に成分を強調すれば薬事法違反になる。
「商品広告に『サミー』と書くだけでも”強調”にあたる」というのが厚労省の判断だ。

健康食品 は主に医薬品で使っている成分を使えないが例外もある
以前に、【 健康食品 で 薬機法 を守るための３つのルールでは】細かく紹介していませんでしたが、 健康食品 は主に医薬品で使っている成分を使えないというルールもあります。
当然、そのような成分名を広告で使うこともNGです。
が、例外も当然あり、有名なところだと「タウリン」があります。
タウリンは医薬品で使われる成分なので、タウリンだけを配合すると 薬機法 違反になります。
ですが、たまたまタウリンが入っているタコエキスを使うことは問題ありません。
広告で「タウリン配合！」と書くとクスリと間違える可能性があるためNGとなりますが、「タコ抽出物」と書けばOKになります。
『サミー含有』はNGだが、成分広告はOK
同様に考えると、今回のサミーの件は【サミーが含まれているサミー酵母】を含有しているのであり、『サミー配合』などといわなければ 薬機法 違反にはなりません。
今回のサミーの件では、サミーが主に医薬品に使われる成分なのに『サミー含有』とはっきり書いているところが問題視されているというわけですね。
ただ、このニュースの大事なところは、『最初の成分広告については特に言及されていない』というところです。
今後のマーケティングにおいてはこの部分に着目していく企業も増えると思われます。
っと、今日はちょっとマニアックなネタになっちゃいましたね。
