2022年3月13日10時〜12時「B&Hライター養成講座」の第173回事例検討会を行いました。
事例検討会では、美容健康分野に特化した薬機法関連の情報の共有や、判断に迷う商品・販促物について相談できる場です。

ただ事例を豊富に知っているだけでなく、クライアントの商品サービスの場合にはたとえばどう言い換えるのか、ここまで提案できるとさらに信頼される。

セルフホワイトニング装置は医療機器に該当する？
最近では自宅で手軽に使用できる美容器具も増えましたね。
なかでも歯医者へ行かなくても、比較的安価で気軽に試すことができるセルフホワイトニングもその一つといえます。
今回の事例検討会では「LED照射器とジェル」を商材とするセルフホワイトニング装置は医療機器に該当するのか？についてディスカッションしました。
東京都福祉保健局が実施した薬務課講習会資料には、以下のように記載されています。
Q セルフホワイトニング装置とは？
A 歯に酸化チタンを含む溶液を散布後、LED 照射機器を当て、酸化チタンの光触媒作用により歯表面の汚れを浮き上がらせるもの
Q 医療機器に該当しないか？
A LED照射機器及び酸化チタンを含む溶液ともに医療機器該当
薬務課講習会資料「雑貨等の広告について」(P32)
セルフホワイトニング装置に該当する商品は「医療機器」に該当するため、「雑貨」として取り扱った場合は薬機法違反となります。（東京都薬務課判断）
また、歯磨き類でのホワイトニングの表現について「化粧品の効能の範囲」としては
- 歯を白くする(使用時にブラッシングを行う歯みがき類)。
- 歯のやにを取る(使用時にブラッシングを行う歯みがき類)。
- 歯石の沈着を防ぐ(使用時にブラッシングを行う歯みがき類)。
などがありますが、どれもブラッシングを行う歯磨き粉類とされており、ブラッシングをすることで物理的に歯の汚れが落ちることを意としているため、
『ホワイトニング装置（LED照射×ジェル）によって歯が白くなる』ことは表現できないので注意が必要です。

なかには今回のセルフホワイトニング装置のように、医療機器に該当する商品も少なくありません。
